Hotel Conditions of Sale

Booking Terms & Condition of Sale

These terms apply to all reservations made with any Doma Hotel including but not limited to; Hotel Realm, Burbury Hotel, Brassey Hotel, Pinnacle Apartments, LN Hotels and Marina Resort.

Making a Booking

A booking is confirmed once:

  • you receive written confirmation from Doma Hotels or the travel agent/website used to reserve the accommodation
  • As per the applicable rate booking rules, any required payment or deposit has been received.

The person making the booking is responsible for all guests in the booking.

You must be 18 years or older to make a booking and stay in the room. Any guest who is 17 years or younger needs to be accompanied by an adult to use the accommodation.

Rates & Payments

All rates are in AUD and include GST unless stated otherwise.

We may require:

  • full prepayment
  • or a deposit
  • or a valid credit card guarantee

We may charge your card in accordance with these terms.

Cancellations & No-Shows

Your cancellation rights depend on the rate and associated policies booked.

  • Flexible — Free cancellation up to 24 hours before arrival
  • Non-Refundable — No refunds if cancelled within 24 hours of making the booking
  • No-show — Charged 100% of the first night or full booking

If you do not arrive and do not cancel within the cancellation period, it is treated as a no-show.

Changes to Bookings

Changes are subject to availability and may result in different rates or fees.

For non-refundable bookings, changes can only be made within 24 hours of making the booking.

Check-in & Check-out

Check-in from: 2pm (excluding Marina Resort at 3pm)
Check-out by: 11am (excluding Marina Resort at 10am)

Photo ID and a valid credit card will be required at check-in.
A security bond may be pre-authorised.

Guest Behaviour & Damage

Guests must:

  • behave in a safe and respectful manner
  • follow hotel rules
  • not cause damage or disturbance

You are responsible for any loss, damage or extra cleaning caused by you or your guests. Your card will be charged to recover these costs.

Liability for Personal Property

We are not responsible for loss or damage to guest property unless required by law.

Force Majeure

We are not liable for failure to provide accommodation due to events beyond our control (e.g. natural disasters, government restrictions, power outages).

Photography and Videography Use

Any activity for commercial or promotional use (including all photography and videography) is prohibited anywhere within the hotel and its grounds without the prior written consent of Management and, without an authorised location agreement and acknowledgement form.

The use of professional camera equipment in and around any DOMA Hotel public spaces is not permitted. Including Brassey Hotel, Hotel Realm, Burbury Hotel & Apartments, Marina Resort and all Little National Hotels.

Management reserves the right to cancel accommodation and request the immediate cessation of any activity taking place in breach of this policy.

Unauthorised imagery or video must not be published on any media and must be immediately removed from the public domain upon request from hotel Management.

Hotel rooms are solely for guest accommodation and enjoyment. Hotel rooms are not to be used as locations for commercial or unauthorised activity including but not limited to photoshoots, pop up shops, trunk shows and so on.

Please note that DOMA Hotels has strict guidelines in place to protect guest privacy. All media, commercial and promotional photography, videography, and activities require prior written approval from Management. Australian Consumer Law

Nothing in these terms excludes or limits your rights under the Australian Consumer Law, including guarantees that services will be provided with due care and skill.

If a service fails to meet a consumer guarantee, you may be entitled to a refund, replacement, or compensation.

Governing Law

These terms are governed by the laws of NSW and ACT in Australia

Privacy Policy

This Privacy Policy applies to the collection, storage, use and disclosure of personal information by or on behalf of any Doma Group entity trading as either Hotel Realm, Burbury Hotel, Pinnacle Apartments, Little National, Brassey Hotel or any other related entity (referred to in this policy as Doma Group, our, we or us). Please read it carefully.

We are committed to protecting your personal information, and ensuring its privacy, accuracy and security. We handle your personal information in a responsible manner in accordance with the Privacy Act 1988 (Act) and the Australian Privacy Principles (APPs).

You do not have to provide us with your personal information. However, if you do not, we may not be able to conduct business with you.

By using any of our products or services, visiting any of our websites or giving us your personal information, you agree to your information being collected, stored, used and disclosed as set out in this Privacy Policy.

1. What Do We Mean by ‘Personal Information’?

References to ‘personal information’ or ‘sensitive information’ in this Privacy Policy have the following meanings:

Personal information means information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether true or not, and whether or not recorded in a material form. Unless a contrary intent appears, in this Privacy Policy ‘personal information’ may also include one or both of the following, as defined in the Act: credit information and credit eligibility information.

Sensitive information (a type of personal information) has the same meaning as in the Act. In summary, it means information or an opinion about an individual’s race or ethnic origins, political opinions and associations, religious beliefs or affiliations, philosophical beliefs, sexual preferences or practices, trade or professional associations and memberships, union membership, criminal record, health or genetic information or biometric information.

2. Collection of Personal Information
(a) Whose Personal Information Do We Collect?

We may collect your personal information from a range of sources, including from you, recruitment agencies, contractors, business partners and government agencies.

For example, we may collect your personal information when you:

(i) request or acquire a product or service from us, including hotel accommodation, functions, conference and leisure facilities, and food and beverage products;

(ii) provide a service or product to us;

(iii) apply for employment with us; or

(iv) communicate with us via our website, by email, telephone or in writing.

Wherever reasonable and practicable, we collect personal information from the individual to whom the information relates. If you provide personal information about someone other than yourself, you agree that you have that person’s consent to provide the information for the purpose for which you provide it to us, and that you have informed them of this Privacy Policy.

We may also collect personal information from other people and organisations, such as travel agents and third-party accommodation booking platforms.

(b) What Types of Personal Information Do We Collect and Hold?

The personal information we collect may include:

(i) names, addresses, email addresses, phone numbers, payment details (including credit card information), guest identification, occupation, accommodation preferences and other information required to provide and market our services;

(ii) credit information, including identification information, repayment history, credit type and amount, default information, court proceedings, insolvency information, publicly available creditworthiness information and credit scores;

(iii) information about staff and directors required for human resource management and business operations; and

(iv) information about current and former suppliers and clients.

We will only collect sensitive information:

(v) where you have consented (for example, limited health information relating to dietary or accessibility requirements); or

(vi) where required or permitted by law.

(c) How Do We Collect Personal Information?

We collect personal information by lawful and fair means, including through:

(i) hotel accommodation reservations;

(ii) function, conference and hospitality bookings;

(iii) face-to-face meetings, interviews and telephone calls;

(iv) business cards;

(v) electronic communications such as emails;

(vi) forms completed by individuals;

(vii) third parties such as recruitment agencies or representatives; and

(viii) our websites.

(d) Why Do We Collect Personal Information?

We collect personal information to:

(i) provide the products and services you request;

(ii) market and communicate information about our products and services;

(iii) improve our products and services; and

(iv) conduct our business, including managing credit and meeting legal obligations.

If you do not provide personal information, we may be unable to provide services, employ you or otherwise deal with you.

(e) Unsolicited Personal Information

If we receive unsolicited personal information that we could not lawfully have collected under the APPs, we will destroy or de-identify it where lawful and reasonable.

(f) Anonymity and Pseudonymity

Where lawful and practicable, you may interact with us anonymously or using a pseudonym. This is not practicable for hotel accommodation, as identification is required at check-in.

3. Use and Disclosure of Personal Information
(a) Use of Personal Information

We use personal information only for the purpose it was collected, related purposes, or where required or permitted by law.

(b) Disclosure of Personal Information

We may disclose personal information to service providers, authorised parties, business partners, advisers, government agencies, or where required or permitted by law.

(c) Marketing Communications

You may opt out of marketing communications at any time by contacting us or using the unsubscribe link provided.

(d) Sensitive Information

We only use or disclose sensitive information for permitted purposes or with your consent.

4. Disclosure of Personal Information Overseas

We do not disclose personal information outside Australia unless required or permitted by law.

5. How Is My Personal Information Kept Secure?

We take reasonable steps to protect personal information through physical, technical and organisational safeguards. Where information is no longer required, it will be de-identified or destroyed.

6. Data Quality, Access and Correction

You may request access to or correction of your personal information by contacting us. Requests are handled in accordance with the Act.

7. Identifiers

We do not use government-related identifiers unless required or permitted by law.

8. Complaints

If you have a privacy complaint, please contact our Privacy Officer. Unresolved complaints may be referred to the Australian Privacy Commissioner.

9. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. Continued use of our services constitutes acceptance of the updated policy.

10. Hotel Conditions of Sale

I agree that my liability for my hotel bill is not waived and that I am financially responsible for all charges incurred during my stay, including cancellations, damages and cleaning fees. All DOMA Hotels are non-smoking and non-vaping venues. Check-in is from 2:00pm and check-out is by 11:00am.
